Article III, Section 1 of the Constitution provides that "[t]he judicial Power of the United States, shall be vested in one Supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish." Under this section and the Judiciary Act of 1789, the United States Supreme Court was created. Marbury v. Madison, Chief Justice Marshall asserted that the doctrine of judicial review permitted the Court to review the constitutionality of congressional legislation.
